DEMO WAIVER & PARTICIPATION AGREEMENT

Aquila Cycles — Demo Bike Program. This Participation Agreement ("Agreement") is between you ("Participant") and Aquila Cycles ("Aquila") and applies to your use of any demonstration bicycle, wheelset or equipment ("Demo Bike") provided by Aquila, whether at an Aquila showroom, event, or on public roads. Please read it carefully — by signing at pickup you give up significant legal rights.
1. Eligibility & Authority
You confirm you are at least 18 years of age, or you are the parent/legal guardian of a minor participant and have full authority to sign on their behalf. A valid government-issued photo ID is required at pickup. Aquila may decline or end any demo at its discretion.
2. The Demo Bike & Your Responsibility
- The Demo Bike is provided in safe working order. Before rolling out, you and an Aquila staff member will complete a short pre-ride check together — brakes, thru-axles, tire pressure, fit.
- You agree to return the Demo Bike at the agreed time, in the same condition you received it, normal wear excepted.
- While the Demo Bike is in your care, you are responsible for it — including loss, theft, and damage beyond normal wear. Do not leave it unattended or unlocked.
- Do not modify the Demo Bike or attempt repairs. If anything feels wrong, stop riding and contact us.
3. Assumption of Risk
Cycling is an inherently risky activity. Risks include, without limitation: falls and loss of control; collision with vehicles, other riders, pedestrians or objects; road, trail and weather conditions; mechanical failure; and the actions of others. These risks can result in serious injury, paralysis, death, and damage to property. You voluntarily accept and assume all such risks, whether or not listed above, arising from your participation in the demo program.
4. Release & Waiver of Claims
To the fullest extent permitted by law, you release, waive and discharge Aquila Cycles, its owners, directors, employees, contractors and affiliates (the "Released Parties") from any and all claims, demands, damages or causes of action arising out of or related to your participation in the demo program, including claims arising from the ordinary negligence of the Released Parties. Nothing in this Agreement excludes liability that cannot be excluded under applicable law, including liability arising from gross negligence or wilful misconduct.
5. Indemnification
You agree to indemnify and hold harmless the Released Parties from any claim brought by a third party arising out of your use of the Demo Bike, including claims arising from your violation of traffic laws or this Agreement.
6. Fitness to Ride
You confirm that you are physically fit, competent to operate a performance road bicycle safely, familiar with drop-bar braking and electronic shifting (or will ask us to walk you through it), and not under the influence of alcohol, cannabis or any impairing substance. Demo rides are unsupervised — Aquila does not accompany or monitor your ride.
7. Safety Rules
- An approved cycling helmet must be worn at all times while riding. No helmet, no demo.
- Obey the Ontario Highway Traffic Act and all applicable traffic laws and signals.
- Ride within your limits and adjust for traffic, surface and weather conditions.
- Demo rides take place during daylight hours only, on the route window agreed at pickup.
- Report any crash, incident or mechanical issue to Aquila immediately upon return — or by phone if you need assistance mid-ride.
8. Photos & Media
Demo days may be photographed or filmed. By participating you consent to Aquila's reasonable use of event imagery that may include you, in Aquila's marketing channels. If you'd prefer not to appear, tell a staff member at check-in and we'll make sure you're left out.
9. Severability
If any provision of this Agreement is found unenforceable, that provision will be limited to the minimum extent necessary and the remainder will continue in full force.
10. Governing Law
This Agreement is governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. Any dispute will be resolved in the courts of Ontario.
11. Acknowledgement
By signing at pickup, you confirm that you have read and understood this entire Agreement, that you are signing voluntarily, and that you understand you are giving up substantial legal rights, including the right to sue the Released Parties for the claims released above.
